Filing a DMCA takedown notice

If you believe content on spikerrealty.com infringes your copyright, you may send a written notice that includes all of the following:

  1. A physical or electronic signature of the copyright owner (or a person authorized to act on the owner’s behalf).
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material on the site that is claimed to be infringing, including the URL or other specific location.
  4. Your contact information — name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.

Counter-notification

If you believe material that was removed (or to which access was disabled) is not infringing, or that you have authorization to use it, you may send a counter-notification including the items above, plus:

  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your consent to the jurisdiction of the federal court for the judicial district in which your address is located.

Repeat infringers

We may, in appropriate circumstances and at our discretion, terminate the access of users who are repeat infringers.

Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages.
